TERMS OF SERVICE (TOS)

Legal Notice: KlyroNodes is a commercial brand operated by Yara Marín Mijangos, a registered self-employed professional (Autónoma) with legal residence in La Rioja, Spain (hereinafter referred to as "the Company", "We", "Us", or "Our").
Welcome to KlyroNodes. By activating an account, purchasing any service, or utilizing our infrastructure, you (hereinafter referred to as "the Client", "User", or "You") agree to be bound by the following Terms of Service. If you do not agree to these terms, you must not use our services.
1. Legal Entity & Contractual Relationship
1.1. This agreement constitutes a legally binding contract between the Client and Yara Marín Mijangos.
1.2. The services provided consist of digital game server hosting (specifically Minecraft Java/Bedrock and related infrastructure), utilizing a specialized containerized allocation model (Calagopus/Pterodactyl).
1.3. You must be at least 13 years old to use our services. If you are under the age of majority in your jurisdiction (usually 18), you must have the explicit consent of a parent or legal guardian to make a purchase.
2. EU Right of Withdrawal Exemption
2.1. In accordance with European Union consumer protection laws, consumers generally have a 14-day right of withdrawal. However, pursuant to Article 16(m) of the Consumer Rights Directive, this right is waived for digital content and services that are provisioned and executed immediately.
2.2. By purchasing a server from KlyroNodes, you expressly consent to the immediate provisioning of the digital resources and acknowledge that you lose your right of withdrawal once the server container is activated.
3. Infrastructure & Service Delivery
3.1. Infrastructure Layout: Our billing system (Paymenter) and main control panels are hosted securely on enterprise-grade infrastructure in France (OVHcloud). The game server nodes are hosted across global datacenters (including Beauharnois, Canada, and other regions) chosen by the Client during the checkout process.
3.2. Service Provisioning: Services are provisioned automatically upon confirmation of payment by our payment gateways. In rare circumstances requiring manual fraud verification, deployment may be delayed for up to 24 hours.
4. Resource Usage & "Fair Use" Policy
4.1. Hardware Integrity: We commit to providing genuine, non-inflated hardware allocations. The RAM and NVMe storage allocated to your purchased plan are physically reserved for your container on the node.
4.2. CPU Limits: CPU allocations are enforced as dynamic bursting allowances via container quotas. While we encourage maximum performance, continuous 100% utilization of allocated CPU threads that negatively impacts the node's overall stability is subject to review and mandatory optimization requests by our technical team.
4.3. Storage Constraints: NVMe storage must be strictly used for active game server files (e.g., worlds, plugins, modpacks, configurations). Using your server allocation as general cloud storage, a personal backup repository, or a file-sharing directory is strictly prohibited and will result in data removal or account suspension.
5. Acceptable Use Policy (AUP) & Content Moderation
5.1. The Client agrees that our services will not be used for malicious, disruptive, or illegal activities, including but not limited to:
- Running crypto-miners, botnets, DDoS scripts, network scanners, or torrenting software.
- Hosting or distributing malware, spyware, pirated software, or cracked plugins (nulled software).
- Attempting to bypass Pterodactyl/Docker container isolation or attempting to gain unauthorized root access to the host node.
- Engaging in activities that intentionally trigger inbound or outbound network attacks.
5.2. Digital Services Act (DSA) Compliance: We reserve the right to monitor, suspend, or terminate services immediately and without notice if we detect content or activities that violate this AUP or applicable EU/Spanish laws. Violation of the AUP revokes any right to a refund.
6. Billing, Payments, & Refund Policy
6.1. Billing Cycle & Gateways: All services are billed on a recurring subscription basis via Paymenter. We exclusively use Stripe (for credit/debit card processing) and PayPal as our authorized payment gateways.
6.2. Late Payments: If an invoice remains unpaid on its due date, the service will be automatically suspended. The server data will be securely held for a grace period of up to five (5) days, after which the container and all associated data will be permanently and irreversibly purged from the node.
6.3. Chargebacks & Disputes: Any chargeback, dispute, or buyer protection claim initiated directly through PayPal or your credit card provider (via Stripe) without prior communication with our support team is considered a breach of contract. This action will result in the immediate suspension of all active services and the permanent ban of your KlyroNodes account.
6.4. Refund Policy: Due to the nature of our immediate digital provisioning, refunds are evaluated strictly on a case-by-case basis.
- Clients may request a full refund within forty-eight (48) hours of their initial purchase only if the service exhibits verifiable technical faults, hardware failure, or extended downtime caused entirely by KlyroNodes' infrastructure.
- Refunds will not be issued for buyer's remorse, user-side misconfigurations, lag caused by unoptimized Minecraft modpacks/plugins, or violations of the AUP.
7. Backups & Data Loss
7.1. We maintain remote, off-site backup infrastructure (Backblaze B2) to ensure system disaster recovery.
7.2. While automated daily backups are provided as a feature, the Client acknowledges that data integrity is ultimately their own responsibility. We strongly recommend creating and downloading regular local backups of your server directories.
7.3. Yara Marín Mijangos shall not be held legally or financially liable for data corruption, lost progress, or software failures caused by Minecraft update anomalies, corrupt plugins, database corruption, or user error.
8. Governing Law & Dispute Resolution
8.1. These Terms of Service are governed by and construed in accordance with the laws of Spain and the regulations of the European Union.
8.2. EU Online Dispute Resolution: In compliance with EU regulations, consumers may seek alternative dispute resolution through the European Commission's ODR platform, accessible at: http://ec.europa.eu/consumers/odr/.
8.3. Any legal disputes or claims arising out of these terms that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the competent courts in La Rioja, Spain.
