By accessing our services, purchasing a server, or using our control panel (Calagopus), you agree to be bound by these Terms of Service (TOS).

Age Requirement: By using our services, you represent and warrant that you are at least 18 years of age or have valid parental/guardian consent to enter into this agreement.

These services are provided by Yara Marin, operating commercially as KlyroNodes.

3. Services and Infrastructure

KlyroNodes provides high-performance web hosting and dedicated server infrastructure.

  • Management Infrastructure: Our billing (Paymenter), control panel (Calagopus), and management nodes (Calagopus Wings) are hosted on an OVH VPS in France.
  • Customer Servers: To ensure optimal global latency, customer server nodes are primarily hosted on OVH Dedicated Servers in Canada. We reserve the right to utilize other locations to meet performance requirements.
  • Hardware Standards: We provide high-performance hardware, typically utilizing AMD Ryzen 9 5900x architectures or superior.

4. Payments, Billing, and Taxes

  • Payment Gateways: All transactions are processed securely via PayPal or Stripe. KlyroNodes does not store your sensitive credit card or banking information.
  • Pricing and VAT (IVA): All prices are exclusive of VAT (IVA). Tax will be calculated and added to your total at checkout according to your applicable tax rate.
  • Billing Management: All subscriptions, invoices, and service changes are managed through our Paymenter billing system.

5. Refund Policy and Right of Withdrawal

  • Right of Withdrawal (EU Law): For digital services, the consumer's right of withdrawal (desistimiento) expires once the service has fully begun (e.g., the server has been provisioned), provided the consumer has given express consent to begin the service immediately and acknowledged the loss of their right of withdrawal.
  • KlyroNodes Satisfaction Guarantee: As a gesture of good faith, KlyroNodes offers a 7-day refund window from the time of provisioning. To qualify, you must provide a valid and legitimate reason (such as technical failure on our end, excluding user error or third-party software) for the cancellation.
  • Limitation: Once the 7-day provisioning window has passed, no refunds will be issued.

6. Acceptable Use Policy (AUP)

You agree NOT to use KlyroNodes services for:

  • Any activity violating Spanish, EU, or Canadian laws.
  • Conducting or participating in Distributed Denial of Service (DDoS) attacks.
  • Distributing malware, ransomware, or viruses.
  • Sending unsolicited bulk emails (Spam).
  • Hosting content that infringes upon intellectual property, is illegal, or violates community standards.

Failure to comply may result in immediate suspension or termination of services without refund.

7. Limitation of Liability

KLYRONODES (YARA MARIN) PROVIDES ALL SERVICES "AS IS."

To the maximum extent permitted by Spanish law, KlyroNodes, its owners, and affiliates shall not be liable for any indirect, incidental, or consequential damages, including:

  • Loss of data, files, or configurations.
  • Service interruptions caused by third-party infrastructure providers (e.g., OVH).
  • Loss of revenue or profits.

Nothing in this section shall exclude or limit liability for death, personal injury, fraud, or gross negligence.

DATA BACKUP: It is your sole responsibility to maintain regular, external backups of all your data. KlyroNodes is not responsible for data loss resulting from hardware failure, software error, or user error.

8. Governing Law and Jurisdiction

These terms are governed by the laws of Spain.

  • B2B: If you are using our services as a business entity, any disputes shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain.
  • B2C: If you are using our services as a consumer residing in the EU, you have the right to bring a claim in the courts of your place of residence as guaranteed by consumer protection laws.

Language Precedence: If this document is translated into other languages, the English version shall prevail.
